Introduction to the User Agreement:
Welcome to Caminos, the online store (registered under commercial registration No: 4031244068) and fully owned by Limitless Trading Company. "We would like to inform you that below you will find the terms and conditions governing your use of this store and all the legal effects resulting from your use of the store's services through this digital platform, as the use of Caminos by any person, whether a consumer of a service or a store product, or otherwise, constitutes their agreement and acceptance of this agreement in its entirety, and confirms their commitment to its rules and provisions.
This agreement applies to all types of transactions between the user and the store. This agreement is effective and enforceable as soon as you agree to it and register with Caminos under Article 10 of the Saudi Electronic Transactions Law.
Article (1) - Introduction and Definitions:
The introduction above is an integral part of this agreement. Below, you will find the definitions and interpretations of key terms used throughout this agreement, presented in a clear and organized manner for easy reference.
1. The word (Caminos) refers to Caminos, and this definition includes all forms of Caminos on the internet, whether it is an electronic application, a website, or a physical store.
2. The Word (User) refers to any consumer who purchases a product or service from the store through its digital platform.
3. The word (Agreement) refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.
Article (2) - Legal Eligibility of the User:
1. The user acknowledges that they are legally eligible to engage in transactions with the store, or they are at least eighteen years of age.
2. If the user violates this article, they agree to accept responsibility for any consequences that may result for others.
Article (3) - Nature of Caminos' commitment:
1. Caminos is committed to providing consumers or users with products.
2. Caminos may provide additional services, such as after-sales or related services, based on the type and nature of the product requested by the user.
Article (4) - Caminos Usage Controls:
1. The user is obligated to use Caminos' digital platform in compliance with the public morals and applicable laws in the Kingdom of Saudi Arabia.
2. When purchasing a Caminos product or service, the user agrees not to use it in a way that violates the public morals and applicable laws in the Kingdom of Saudi Arabia.
Article (5) - Accounts and Registration Obligations:
By submitting your application to become a Caminos member as a user, you agree to disclose specific information and choose a username and password to access Caminos services, as well as the following terms and conditions:
1. You are responsible for maintaining the confidentiality of your account information and password. You agree to notify Caminos immediately of any unauthorized use of your account information or any other breach of your confidential information.
2. Caminos is not responsible for any direct or indirect moral or material loss that may result from the disclosure of your username or login password.
3. You are fully responsible for the use of your Caminos account or membership. If someone else uses your account, it will be presumed that you have authorized them to do so.
4. You are obligated to use Caminos in a serious and honest manner.
5. You are committed to providing true, accurate, updated, complete, and legal information about yourself during registration with Caminos. You are also responsible for updating your information when it changes or when necessary.
6. Caminos is committed to maintaining the complete confidentiality of your personal and contact information.
7. Caminos may suspend or terminate your account immediately if it becomes aware that you have provided false or misleading information.
8. Any failure to comply with the above terms and conditions may result in immediate suspension or termination of your store or membership by Caminos management, or the blocking of your access to Caminos services again.
Article (6) - Electronic Communications and Official Communication Methods
1. The parties to this agreement agree to conduct all communication via the email registered on the platform.
2. The user agrees that all agreements, notices, data, and other communications provided electronically shall be treated as legally binding and have the same legal effect as written documents in meeting regulatory and legal requirements.
3. The user acknowledges that Caminos management may communicate with them and provide notifications of any provisions related to this agreement or dealings with them through public messages broadcasted to all users or specific users of Caminos.
Article (7) - Amendments to the Terms of Use and Fees:
1. Caminos reserves the right to make changes to this agreement and its fees at any time. If any changes are made, Caminos may inform you through the official means of communication outlined in this agreement. You agree that any amendments to this agreement will modify your obligations or rights accordingly.
2. In the event of any objection to an amendment to the Terms of Use, Caminos requests that you discontinue the use of its services. Your continued use of Caminos services, or access to your Caminos account, constitutes your acceptance of the amended terms and agreement, which cannot be waived by ignorance. Caminos is open to discussion on any proposals regarding these terms.
3. All fees shall be computed in Saudi Riyals and shall be the sole responsibility of the user. The user shall settle all dues and other charges levied by Caminos, and payment must be made through the approved channels specified on the Caminos platform.
4. Caminos may charge fees to certain users based on the nature of the offers, products, or services they request, as well as any applicable fees or taxes imposed by the state
5. Caminos reserves the right to modify or adjust any fees under the terms and conditions of this agreement, which may include adding, increasing, decreasing, or deducting fees or expenses for any user, regardless of the reason for their registration.
Article (8) - Payment and Settlement Services for Stores on Caminos:
1. Caminos, in partnership with various providers, offers a comprehensive online payment and settlement system on Caminos. This system allows for payments to be made using Caminos' available payment options, as well as any other payment method that Caminos may introduce in the future
2. Caminos is committed to setting the prices for the products displayed in its store based on the recognized market value.
3. Caminos is committed to providing users with invoices for their purchases made at Caminos, as well as for all amounts and profits generated in the store.
4. Caminos is committed to providing the accounting specifications recognized in its electronic store, in accordance with the provisions of this agreement, as well as the legal, economic, and commercial interests outlined in the applicable regulations
Article (9) - Your Personal Information and Transaction Details:
1. The user acknowledges that they grant Caminos an unlimited, worldwide, perpetual, non-revocable, royalty-free license to use any personal information or materials provided or made available by them through the communication and registration forms or any electronic message or communication channel available on the Caminos platform, for any purposes deemed necessary by the platform
2. The confidentiality provisions regarding customer information provided to Caminos are subject to the rules outlined in Caminos' Privacy Policy and Confidentiality of information, as well as any other provisions related to information confidentiality specified in this agreement.
Article (10) - Intellectual Property:
1. The intellectual property rights of Caminos are entirely owned by Caminos, whether acquired before or after the establishment of this digital platform.
2. The user or consumer shall respect Caminos' intellectual property rights, including Caminos itself, as well as any words, logos, or symbols that are specific to Caminos or displayed on the Caminos platform. This is because Caminos and all rights related to it, including its intellectual property, are exclusively owned by Caminos.
Article (11) - Caminos's Responsibility:
1. Caminos is committed to providing its services through this digital platform in accordance with all applicable laws and regulations in the Kingdom of Saudi Arabia, as well as the terms and conditions outlined in this agreement
2. Caminos shall not be held liable for any claims arising from errors or negligence, whether caused directly, indirectly or by the user or through the actions of a third party, including but not limited to issues related to shipping or handling.
3. Caminos, along with its employees, owners, and representatives, is committed to providing legal, legitimate, and authorized products and services in accordance with the laws and regulations of the Kingdom of Saudi Arabia, and ensuring that they are used for legitimate purposes."
Article (12) - Confidentiality of Information:
1. Caminos adopts tangible, regulatory, and technological standards to protect users and prevent unauthorized access to personal user information and keep it confidential.
2. As a user, you acknowledge that the internet is not a completely secure medium, and the confidentiality of your personal information through Caminos cannot be guaranteed 100%.
3. Caminos has no control over the actions of any third party or others, such as other web pages linked to the platform or third parties claiming to represent you or others.
4. By using Caminos, you acknowledge and agree that Caminos may use the information you have provided for the purpose of providing services to you on Caminos and sending marketing messages to you. You acknowledge that the privacy of your personal information included collecting, processing, using, and transferring of your personal information is governed by Caminos's Privacy and Confidentiality Policy.
Article (13) - Restriction of User Access or Membership:
Caminos may suspend or terminate a user's membership, or restrict the user's access to the platform services, at any time, without notice and for any reason, without specifying.
Article (14) - Applicable Law or Regulation:
This agreement is governed and formulated in accordance with the laws, regulations, and legislation in effect in the Kingdom of Saudi Arabia, and is entirely subject to the applicable regulations of the authorities in the Kingdom of Saudi Arabia.
Article (15) - General Provisions:
If any provision or clause of this agreement is cancelled, or if any provision or clause of the agreement becomes invalid, it shall not affect the validity of the remaining provisions, clauses, or provisions, which shall remain in effect until further notice from the Caminos administration
This Usage Agreement constitutes the agreement, understanding, and contract between Caminos and the user, and may be modified from time to time as necessary. Both parties agree to consider the following:
1. The Arabic language is the language applicable when interpreting the provisions of this agreement, or when translating it into another language.
2. All prices displayed for Caminos services or products may be subject to change from time to time.
3. Any promotional or marketing offers presented by Caminos are temporary and subject to modification or suspension by Caminos at any time.
4. The parties to this agreement agree to conduct their dealings with each other in accordance with relevant legal rules, regulations, and laws that apply to their interactions with Caminos and the user
5. This usage agreement can only be canceled by a decision issued by the Caminos administration
